WIBTA if I called hr on my coworkers for smoking where they know it makes my asthma act up

WIBTA if I reported my coworkers to hr for smoking outside the building I work in. I work the parts counter for a mechanic shop inside a dealership. there is no climate control in this shop which means open bay doors all day. when it’s cold we try to keep them closed but the main door has to be opened most of the day to let cars come and go. there are a few people that prefer to smoke just outside the main door. I have just a touch of asthma and thr smoking only bothers me when it’s constant or when im already sick.

well I’ve been sick a few times this winter. Last time I was sick I said something to the service manager about how the smoking was bothering me and it had bothered others in thr past. he taked to everyone and said they have to smoke in the employee parking lot. that lot is not much farther to walk but there’s no protection from the wind. plus we are supposed to be a smoke free facility as the owners do not like smoking.

this lasted about a month as they are back to smoking right outside the door although they now stand off to the side so they are not visible. of corse im sick again. im about the email HR, which is off-site, as I cant take it anymore. honestly im upset that their nicotine fix is more important that my health.

Here’s where I may be the a******e
Someone told me im being too sensitive and they have the right to take their smoke brakes. That it is too cold to smoke in the employee lot and they don’t always have the time to walk all that way.

  1. NTA – Speak to HR and protect your health. If your colleagues want to kill themselves smoking then that is their right, but it should not impact you in any way. whoever said you are being sensitive is a fool. Stand your ground on this, you are 100% in the right.

  2. NTA. Medical conditions trumps the choice to smoke. Just as “they have the right to smoke breaks” (which imo is a stupid reasoning but, I digress) you have the right to breathe clean air.

  3. NTA – this occurred in an office I worked at – going into the back door was like going through a 1930’s bar. HR eventually told them they had to be 50 feet from the building – with the exception they can smoke in their car. They complained they didn’t want their car to smell like smoke. Duh – we don’t want to smell it either.

  4. NTA….You aren’t the asshole for prioritizing your health over their convenience, especially since they are violating a smoke free policy and a manager’s direct order.

  5. NTA, i’ve been having a similar battle over people that drown themselves in cologne causing me migraines.

  6. Always remember that HR is ultimately protecting the business, not you. Make sure ALL your ducks are in a row before going to them. Do not threaten you’ll do anything like sue them if they don’t act on it.

  7. NTA, I’m a smoker and personally have always been self-conscious of things like this because typically the smoker cannot smell it themselves.

  8. NTA The rule about where smoking is already exists. Management is being lazy.

    I worked in an office for a company that didn’t allow smoking anywhere on the property, not even in your car. When the weather wasn’t nice, several smokers would pile into a car and drive around the neighborhood for their smoke breaks. The smell on them and their clothes was awful. Like if I entered a bathroom stall one of them had just vacated, I would gag.

  9. NTAH, smoking on a smoke free campus is a shit thing to do. As a former smoker, I would like to mention that they are not only doing this in spite of your health, they are doing this in spite of their own health. It’s an addiction and even talking about it makes me want to smoke and I quit 9 years ago.

  10. NTA. The owners have designated where smoking is allowed and these employees are ignoring the designated area. The excuse of its too far to go so many times a day shows that they are taking multiple unauthorized breaks when they should be working. Your health impact is just icing on the disrespect cake.
